Hi,
I did some search at the "Immigration and customs enforcement" website and got the below links that may help you. You can even call them to find out the answers you are looking for.
Hope everything works out for the kids. God bless.

What type of information will I need to visit a detainee in a detention facility?
A government-issued photo identification or other identification when photo identification is unavailable for religious reasons is required to visit a detention facility. However, you should contact the detention facility you plan to visit in order to find out what their policies and regulations are regarding visitation.

You should have asked before filing for an extension or do a search at USCIS Home Page (http://www.uscis.gov) you would have come across the below:
USCIS - Special Situations (http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=f34d3e4d77d73210VgnVCM100000082ca60aRCR D&vgnextchannel=f34d3e4d77d73210VgnVCM100000082ca60a RCRD)
I don't know if you can get the fee back since the extension has been approved. Next time, ask when you are not sure.

Does anyone know if we need any special visa for working in Canada if you have a US GC?
One of my relative did work in Vancouver, Canada with his GC. He got his work permit at Canadian port of entry. Anyway this was long back, so please do your research, rules might have changed since then.

Are you married to a USC? If so, you have nothing to worry about. Do not travel until your GC is approved as AP is not 100% safe for people that overstayed.

I have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.
If any one can throw some light on it , would be Great.
Thanks
Confused Desi,:)
Welcome to world of GC.As of now,you will able to get your GC may be in 8-12yrs(minimum years) and the max cannot be calculated. If you have on your first H1 then it is right now to file for GC as you may get 3-year extension based on I140 approcal after you finish all the six years on H1..or some kind of bill may get passed before you complete all the six years and you will get the plastic(GC)..

It is mentioned by many that PD should be current at the time of GC approval. Is that right?
I know people from India who got their GC approved when their PD is not current.
One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!
The strict rule is that one's PD needs to be current for approval. But if there aren't earlier PDs available for approval ( say stuck in namecheck ) and if USCIS doesn't want to visa numbers for a year to be wasted , then one can get approved even if PD is not current.

Hello,
First of all, I really appreciate your efforts to help people in their immigration issues.
Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
I would really appreciate your help.
Thanks,
Dhans

Hi,
In my case i filed for I-140 and had a notice to deny bacause they put the worng name on the application....
we then refiled a second i-140, but processing was stopped on that because they needed the original labor cert. from my first i-140.
i filed on 19th May, and finally got approved on 27th July, although i did file PP.
So i would say a couple of months is about right for the labor cert. to be transferred from one case to another.

If your title falls under Job Zone 4, you can still apply for EB2. However, there is a possibility that your case will be audited.

We still in negotiation. not come to a stage where EAD has been asked for. i am wondering what else could they ask for other than EAD like do they need to provide any proof that they will sponsor my green card or do i need to file AC21 in advance.

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?
Bunch of thanks!!
Make sure you get a copy of approved I-140.

You can stay here as long as the I797 is valid (there is no rule to stamp it within a year). Do you have H1B stamped frome before or is this your first H1? If the first one then you have to get it stamped when you travel out of US. If this is not the first one then you can travel back on your old H1 stamp with new I797.
