Talk to a competent attorney. Medical reasons are seen as EXCEPTIONAL cases by USCIS. If the illness is serious enough she will be given preferential treatment and might get visa waiver for the duration of her treatment. A proper attorney can advise further.

Hi guys,
I know this is Off Topic (OT), but I was wondering if ALL Tax payers including immigrants on H1B will be getting the proposed tax rebates. This had happened in 2001 as well and my citizen co-workers remember getting checks.
Does anyone who was on an H1B in 2001 remember getting a similar rebate check? I definitely dont remember getting one.

Hello,
I am working with A on h1b and the visa expires on May 1st 2010.
Recently I got another offer with B and they filed my h1b transfer (regular).
The offer they gave me verbally is different from what's on the offer letter, when I contacted them there insist that they never "promised" , so I did not want to take that offer now.
Can I now ask employer A to file the extension and continue working with A?. Will that create any issues if the transfer with B gets Approved/rejected?. or is there any alternate?. Please help.

There is nothing like H1 transfer. Each petition is separate. Company B filing H1 does not invalidate your H1 from Company A. Your original H1 will still be valid even if H1 from company B is approved/denied. You can just continue working with company A and file extension when its due...

There is nothing like H1 transfer. Each petition is separate. Company B filing H1 does not invalidate your H1 from Company A. Your original H1 will still be valid even if H1 from company B is approved/denied. You can just continue working with company A and file extension when its due...

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

My AP was approved Nov 16. Email from USCIS said approval notice sent. I had to travel Dec 4th. When my lawyer contacted USCIS on Nov 25th, USCIS said they were in the process of printing the form. My lawyer suggested trying for the emergency AP. The Baltimore office says walk-ins not allowed. My travel was postponed for other reasons. Double check that USCIS actually mailed the notices to you.

Q1) I would like to take a US consulate appointment for visitor's visa for my father. We are from southern Andhra Pradesh and Chennai consulate is convenient for us. Since Hyderabad has US consulate, does whole of Andhra come under HYD consulate jurisdiction? or can we take appointment in Chennai Consulate? Could you please let me know? My father is going for visa for the first time.
Q2) If visitor passport is expiring in next eight months and if the visitor is residing in US, is it possible to renew the passport here? Or the person has to go back to India and renew the passport there. I would just like to help my parents with the paper work and get it done if possible when they are here.

It may not be reliable source, By the way did u look at the Sep Visa Appointment at Mumbai Consulate, There is not a Single Employment based persons for the interview which may suggest that Visa numbers are infact over.

I had filed my 485 during the VB fiasco, but did not file for ead/ap, as my H1 was valid. I intend to apply now but not sure what the filing fee is? Can one of you guys who might have filed later guide me on what the fee amount is and the documents that need to go with it. Is Efiling an option?
USCIS website says $340 for the EAD and $304 for AP, but I guess it is the new fee and does not apply to folks who had their AOS filed before July 30, 07.

I dont think you will need them . I am also filing premium 140 and lawyer has nOT asked for all I94s ..ONly the recent one..Dont worry much if you dont have all of them

Me and my wife received our EADs and our H1/H4 is valid till 2010.
My wife is attending school being on H4. Since she has EAD, can she work part time(not in school) and keep the H4 status valid.

Yes he can apply for a TN again, no limit on the number of times alien can enter on TN. If he leaves while his COS is pending it will be considered to be abandonment of the petition.

I am on H1B with Labor approved about 2.8 years ago and I-140 approved for over a year ago.
I am July2007 fiasco filer of Indian origin.....in US for a some 13 years and I am Canadian citizen.
I have almost 2.5 years of H1B still left from my 3 year H1B extension.
I had EAD before but never used it, so my employer has not renewed it.
I am currently working on H1B.
I understand I am not allowed to work in my own business while on H1B, but I can have profit or loss from it......so it doesn't make sense to start a consulting business while on H1B in my opinion (correct me if I m wrong btw).
Starting a Consulting Business on EAD:
Now I want to start a consulting business in the same/similar field of my current job for which my greencard was applied and is still pending.
Please help me with the following:
Q1: Can I start the this consulting business while on EAD? Is LLC the best option?
Q2: Will it be then job portability from my current job to this new job in my company using AC21?
Q3: What conditions do I need to fulfill for working in my own company to keep my greencard alive?
Q4: What evidence do I need to keep handy to show USCIS if asked?
Q5: Am I supposed to inform USCIS when I do this job chnage?
Q6: Are there any minimum revenue requirements or do I have to pay myself same or more salary than my current job?
Q7: What if my business does not take off quickly and I can not pay myself same salary like my current job?
Q8: Can I apply EAD myself or I need my current employer to do so? I have the old expired EAD card that I never used.
Q9: I also don't have my job description from my labor certification. Is there a way for me to get it directly from USCIS?

when i went to SS office for enquiry 1 week back, they told me that my immigration verification was not done yet. so i had to wait.
can anyone help me with this.
how many days will it took to complete the process??

It usually takes 8 weeks tops to complete (after all dig deeeeeeeep checks). Does your first & last name match on passport, 797 and I-94? - this is one of reasons for delay in issuing a SSN. My 2C
