I received a RFE asking for evidence that could prove that currently I am on a non-immigrant status. I abandoned my F-1 status after I filled my I-485, and from what I knew you were supposed to have the corresponding status before you filled the I-485 but there was no need to still have it after you got the AOS.
My question is if there is a possibility that what the officer is asking for is evidence that proves that I HAD the F-1 status before filling the I-485 and if I abandoned it after filling it.

I had a soft touch on my LUD for I-485 yesterday. Have received EAD card and been fingerprinted. Waiting for AP approval. Does anyone have a clue what is this in regards to?

Actually I wanted to know if one doesn't go out of the country and stays back in the US, and remains unemployed for whatever reason for say 6 month or more- medical, personal etc or perhaps just take a break.

Like RNGC said, once you're in parolee status, I94 expiration date is irrelevant. You are in valid status until your I-485 gets approved or denied.

My employer has job posting Bachelor's degree with 7 years of experience but does not say anything about Masters Degree. Wanted to know this job requirement fall under EB2 or EB3?. appreciate for the response.
The advt is very sensitive. My friend lost his eb2 chance because of that.
its MS or Bachelor's degree with PROGRESSIVE experience.
Did you got it screended with your/company attorney about the advt description

Hi,
I am on H1 and may have to use EAD in couple of months. What would be the status of my son (he is on H4) if I use EAD? We filed 485 in July 2007.

If you filed for I-485 for your son as well then he is in Adjustment of Status (AOS), otherwise he may be out of status once you start using your EAD. Talk to an attorney if you have not filed for AOS for your son and plan to use EAD.

You are so fortunate. My priority date is May 2006, but my I-140 was only approved & received by NVC last January. We have similar question. I hope the statement from the FAQ of NVC (check http://travel.state.gov/visa/immigrants/types/types_1309.html) will help us.

There is a delay between when you get the Notice of Receipt and the Notice of Approval from CIS and also between when you get the Notice of Approval and when NVC receives the petition. 'letter from employer that describes the relationship with the Principal Applicant and the purpose of travel'
I would really appreciate it if anybody has a sample of the same or an inkling as to what exactly it is (as far as I know, the employer can provide an employment verification letter, but not stating that the spouse is applying for a dependent visa and so on).

I've filed for the I-140 with EB-1 category in business, then additional evidence was requested and finally received a denial. I would like to know:
1. What are the chances to get approved after appealing? Depends on why it was denied
2. If I were to appeal can I present new evidence? yes you should, else why would you even appeal??
3. After filing the appeal, how long should I expect to receive an answer from DC office? should take atleast 4 months
4. If I ask for additional time before appealing, what are the chances that the additional time will be approved?
5. Is it better to appeal or to request a motion to reopen whenever I gather the new info to defend my case?

Both Wall Street Journal and New York Times have huge headings under "Immigration Law." But the question is not about immigration law. It is about the fundamental human right to not be judged by the color of our skin.
The proponents of the bill, like Arizona state Sen. Russell Pearce say that the bill "prohibits racial profiling." But I wonder if every individual is stopped and asked for their passports. The will cripple business in the State. Will everyone, ie white, black, brown, yellow, and whatever other color or look need to take their passports, birth certificates, etc to Arizona?
I naturalized into this country and is in the highest tax bracket. I work and pay taxes. Yet I am brown and have an accent. As a practitioner of immigration law, I know say for instance white Canadian who are here, in the US, working illegally, but are white and except for a slight "oot and aboot" has no other accent. Who will the Arizona police "catch"?
The lawsuit is also about separate state and federal rights. The Conservative Supreme Court will champion State rights, but it will remain to be seen whether they champion Separation of Powers. My guess is that their judgment will be clouded by the more emotional issue of immigration.

1. Even after leaving the company, is it legal for me to stay in the country and for how long?
2. Can I look for any kind of job on EAD or there is any restrictions?
3. Is it possible that my former employer can cancel my EAD?
4. If I find a new job, do I have to use immigration lawyers of my former employer to help renew my EAD, travel document etc. from time to time or I can hire another immigration lawyer?
