    We had the same situation with my wife's H1-B. We spoke to the lawyer and he had forwarded us an e-mail reply from USCIS, stating that USCIS had decided to issue the validity of 797 from the date of adjudication or approved date rather than from the previous expired h1B date and this is not happening across all the cases. I also have applied at the same time as my wife's h1 and My h1b dates are matching.

    Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.



    The 140 approval notice is not required unless this is a post six year transfer/extension.

    Why do you say tranfer will be denied if extension petition is withdrawn? Are they not seperate applications filed by 2 different companies?

    The lizard is well exposed, but the composition bothers me some. Feels out of balance to the left because of the cactus. The flower & lily pads are very nice, but I really like the butterfly. Good subject isolation and vibrant color.

    Hi there

    I am currently working on F1-OPT with company A. Company A filed for my
    H1B visa and it got approved, which is yet to start from Oct 2010. But now I
    got an offer from Company B. I have to get my H1 transferred to company B.
    I have informed my current employer(Company A) about this transfer.

    But actually they(company A) are planning to withdraw my H1B visa petition
    from USCIS as I will not be working with them from Oct 2010.
    I would like to know if this will affect my visa transfer.
    Can someone please let me know how it works and suggest me what should I do
    to get my transfer done?

    H1b starts mean the day LCA Petition is filed or day I797 is issued ?

    Day 1 means the receipt date of your H1B for Company B.

    Is there anyway we could include EB immigration relief in the Economic Stumilus Package announced by President Bush by bringing up creative pointers such as more greencards = more small businesses, more greencards = more home buyers, etcetera ? I see a faint chance here. With the urgency to kick start the economy, if we can get something on the bill, it will pass and will become a law fast.

    Am I out of my mind or is this feasible.

    Just a heads up about the new filing requirements for I-129s and I-140s. See link. In a nutshell all I-129s go to Vermont Service Center and all I-140s go to the Nebraska Service Center.

    My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?
    Please Let me know this information.

    Dear all,

    I just realized that my lawyer forgot to mention A# in my 485 application. I have an approved I140 and the approval notice does have A# mentioned on it.

    Does any one in this forum know if I am in trouble? I have sent a copy of my I-140 approval notice in my application though.

    Any thoughts/experience?

    There is a policy for accepting asylees from Cuba and allowing them to seek permenant residency.

    Its called the wet feet/dry feet policy. See Here on wikipedia (http://en.wikipedia.org/wiki/Wet_Feet/Dry_Feet_Policy)

    The wet feet, dry feet policy (sometimes called the wet-foot, dry-foot Policy) is the name given to a consequence of the 1995 revision of the Cuban Adjustment Act of 1966 that says, essentially, that anyone who fled Cuba and got into the United States would be allowed to pursue residency a year later. After talks with the Cuban government, the Clinton administration came to an agreement with Cuba that it would stop admitting people found at sea. Since then, in what has become known as the "wet feet, dry feet" policy, a Cuban caught on the waters between the two nations, "wet feet", would summarily be sent home or to a third country. One who makes it to shore, "dry feet", gets a chance to remain in the United States, and later would qualify for U.S. citizenship.


    You better carry a nice towel with you when you come back from Cuba and make sure your feet are dry when apprehended by coast guard. And make sure you dont end up getting kidnapped and killed in Cuba, coz they really dont have very nice law enforcement.

    Are there any rules that you need to leave a country during 30 days after your H1-B got approved. Almost all my friends needed but my lawyer said that I don't need to. I am confused what if he makes a mistake.
