Me and my husband(primary applicant) filed our I 485, I 765, and I 131. Recieved by USCIS on 06/29/2007. our lawyer recently got our reciept nos. my husband got a notice saying FP fee rejected and has been asked to re submit the fee,when, in fact all our checks have already been cashed.all of my notices say case recieved and pending.my question is ,with my husband's case in suspense, will my application be also with held or will USCIS go ahead with my application. I am the dependant spouse in this case. please respond. Thank you.
Isn't husband Important than job or EAD? :) Both of you will be fine. Just get a copy of bank statement with cashed checks from your bank, talk to USCIS customer care and send it to them if required as proof of payment.

Hello,
My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?
PS- I am also an Indian citizen but i will obviously piggy back on her application since my PD is not current.

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.
Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?
I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.
I cant find anything on the net no this.
