We had the same situation with my wife's H1-B. We spoke to the lawyer and he had forwarded us an e-mail reply from USCIS, stating that USCIS had decided to issue the validity of 797 from the date of adjudication or approved date rather than from the previous expired h1B date and this is not happening across all the cases. I also have applied at the same time as my wife's h1 and My h1b dates are matching.

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.



The 140 approval notice is not required unless this is a post six year transfer/extension.

I have one question about signing the affidavit of support (864) for immigration of a family member.
(i.e. For petition for Immediate Relative- daughter files for mother)


If daughter signs an affidavit of support for mother (i.e. form 864) for immigrant visa (Immediate relative) then in that case for daughter is it going to create any problem in getting study loans/home loan in future?

Just curious, how are they related.
I'm not seeing any connection between these items.
Affidavit is for USCIS to show the ability that she can take the financial burden, study loan is for university to decide borrower can able to pay or not and mortgage loan is also the same, in both the cases you have to pay back and in first case it is not.

OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

You are eligible for 3 years extension with the approved I140. I also applied my H1 extension by attaching approved 140 for 3 years extension, I got it last month...

it will not like 2 yrs and then 3 yrs.....go for 3 years...I think lawyer should know all these....

I understood no LC is required for L1A visa holders Greencard processing.

Yes. I did contacted both Kerry and Brown's office last month (July end) for my EAD renewal application.

Both office staff were very receptive. Brown office has more than one person working on immigration matter....and I believe they were first to act on my case. I got EAD approval 4 days later.

According to CIS ,they will take time upto 26th Oct ,just to issue the receipts. Again they say ,it might not be that longer but what I think we are not going to get the receipts anytime soon. At the same time we need not file another application if we dont hear anything from them till 15th of August,since we have the mail delivary proof that the application was accepted at TSC.
So there is no other alternative but to wait for either a receipt or checks getting cashed...

Hello all,

My EAD expired in late April

Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).

I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.

If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?

How do employers handle something like this?

Sorry if I am posting this in the wrong place, wasn't exactly sure where to post.

I applied for my Certifcate of Citizenship through my US citizen father about 5 years ago, and due to that US citizen father being an ass I still don't have it.
I have decided to just go back to England. I am happy about going back now and this post isn't about finding other ways of getting my citizenship.
When I originally came to the US I intended just to visit so I came on the Visa Waiver Program, and then decided to stay and become a citizen

My query is: When I leave to go back home will I be able to leave the US with just my passport(recently renewed) and ticket? or will I have to contact the USCIS and get some kind of letter or the like?

Below is the family based catgory, you can find this in any visa bulletin too.

If your application gets approved before/on 30th June you will get 1 year EAD. If this happens after/on 1st july you should get 2 years. I am in same senario.

Hi folks,

I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.

My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?

Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.

Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.

Ah, that won't really be possible unfortunately by applying it directly to Frame. The Frame is basically a window through which you view the world (XAML pages loaded into it). It has no real control over what gets loaded - it is only a spectator.

What you can do is specify a transition effect on each XAML that plays when that page loads. The end result is that tour frame will display a transition effect, but that transition effect would have been entirely defined in the page that gets loaded instead of having it live on the single page containing the Frame.

Hello,
It will take hours. Let's put it this way; for one letter that is animated to spin, the file size is about 14-20k. Now 10 letters that are animated to spin will be around 200k alone. The process time does take hours.

It all depends on what configuration you have (AMD K6-2 550). On my PC it takes about 30 mins (P3 933), but that is still a long time to watch the Ravix processor draw all the lines individualy. What I usually do for large Swift 3D files, is simply export the outlines only. Then inside flash, I lay the movies on top of each other. So when they move, it creates an illusionary effect. For web based publishing, Swift 3D is just not a program that creates small files.

Finally after numerous logins at USCIS, I saw today..Request for additional Evidence sent
on my I140..I only happen to see when some other guy with Eb3 Pd2005 and Rd of August 15 got his I 140approval...
so I logged in to see ..I too have LUD

I wonder what it may be because I had sent all my W2s since my PD of 2001..

My friend from my company had also received RFE for TAX papers last year. She sent it and was approved..

Hopefully I am too..because I never changed jobs working for the last 8 years....and had prior necessary experience before joining my current job...plus 1 year in current job

1) Will immigration department check back with uni if i am still enrolled (note: i got paper signed from my advisor with my graduation dates on it)
Google SEVIS I-20. The SEVIS system will tell USCIS and universities whether you are in status or not as per F-1 requirements. You will need to get a new I-20 and you are out-of-status until you have one.

2) Should i leave US and apply for a new visa and a new i 20 with that community college?
If yes, then what are my chances of getting a visa?
Don't do it. Your F-1 Visa will most probably be rejected due to this out-of-status issue. You might be able to get a new I-20 from outside the country but not a VISA.

3) What are my options??
Stick with Purdue and do as the International Advisor says (you don't have many options). Hopefully you will be reinstated (Purdue should have issued a new I-20 when they re-admitted you from community college. I am not sure why they overlooked)>

Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?

I don't know how it affects the overall processing times, but there is no problem rescheduling the appointment. Just follow the instructions on your notice.

1 disclaimer - you MUST reschedule it before your original appointment date. Failure to attend your appointment without 1st rescheduling is considered an abandonment of your AOS etc.

I was on an F1 visa until Oct, 2008 and on H1-b visa after that.
The expiry date on my F1 visa stamp is in 2011.

I intend to convert from H1 to F1 . Do I require a new F1 visa stamp or will my old stamping be valid still?

Hi,
I need suggestion on travel.

I have applied AP for my wife on April 16 and still waiting. We have expiated her AP last week, still no updates. She has an emergency travel on June 20th. Her previous AP is valid till June 24th.

Can she travel out side on June 20th and come back with new AP when approved (I can mail her the new one once approved) or dose she needs to be in US until the new AP is approved?

As the old AP is valid till June 24th, dost it mean that they will approve the new one only after June 24th?

As this is an emergency I need your suggestion please...
