F1 is strictly non-immigrant VISA. So having family members in USA has a bearing on F1. On the other hand, bunch of H-1B applicants have relatives in USA. Also H-1B is dual intent VISA. So you should be OK with H-1B.

Hi Guys,
I was reading another thread and a question came to my mind..
I entered in US on AP and got the I-94 with the validity date as my AP date. Now my AP is going to expire and I am not going to travel anywhere any time this year. So just wondering what will happen when the I-94 is expired. Do I have to get it renewed from somewhere or just dun worry about it. or do I have to apply for a new AP.
Can anyone can shed some light on this situation?

Yes I have known people done for H1 and H4 both. My friend who was fron MP usually get his H1 from Mumbai. But Last year he got his H1 stamped from Delhi just because he wants to go to Honeymoon there. Hope this helps.

My spouse currently is in H4. Is it possible to get his F1 visa stamped (with i-20 and other documents) within US? for example, in local USCIS offices.?
Also, does getting COS (h4 to f1) approved means, we can exit and enter US without stamping in INDIA?
Stamping within US is history - However, if COS is approved, your spouse can continue his studies without stamping, but if you exit the country then you need to stamp your F1 and return.

EAD start date: 1st Nov 2007 (Didnt start using it yet)
Occupation Title: Computer Software Enginner
OES Code: 15-1031
New Position: Sales Consultant
For the Sales consultant position the description is much more technical and macthes 50% with whats Computer Software Enginner.
1. What are the immigration steps that need to be considered for the portability(AC21) ?
2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?
Let me know !!

Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.
Example:
LCA start date: 9/1/10
LCA end date: 8/31/13
Form I-129 start date: 10/1/10
Form I-129 end date: 8/31/13
Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.
Although under certain circumstances USCIS has agreed to accept H-1B petitions for processing that include LCAs that have not been certified, attorneys should understand that if the LCA submitted with the H-1B petition is eventually denied, the H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) will be denied, even if a subsequent certified LCA is submitted. This is even true where the denial is due to DOL error in not being able to verify a petitioner's FEIN. Hi firends,
I heard that now all we are getting 2 Year EAD/ AP for renewals. Thats very good news to us. I have couple of questions on this.
1. How do we need to pay for renewal? Fee will be 2 years fee or 1 year fee?
2. Is this one combined document with EAD/AP?
3. Is this process already started?

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.

Could one by considered agricultural worker if they are in landscaping business ? what about in agricultural sales.
We are about to see creation of huge black market for documents claiming someone is farmer if this rule is passed.
Can one be illegally working as Ag worker while on H1 ? :)

Unfortunately, the only solution is to take your camera to a Nikon repair center. It seems that the D2H's meter failing is alarmingly common, from what reports one reads online. If your camera is yet under warranty, then you're in luck. Otherwise, it may be a US$200 - $300 repair. :(
